COBRA Health Insurance Coverage When You're Fired

By

Definition: If you are fired for reasons other than gross misconduct, you may be able to continue health insurance cover under COBRA.

Companies with group health plans which cover 20 or more employees are required to provide COBRA (Consolidated Omnibus Budget Reconciliation Act) benefits to employees and their families who lose health benefits.

However if an employee is fired for gross misconduct he or she is not eligible for coverage. If an employee is terminated for performance reasons or any other reason than gross misconduct he or she is eligible to continue coverage.

For more information on COBRA eligibility visit the COBRA section of the Department of Labor web site. If you believe you should be covered and need help with compliance, there is compliance assistance available from the DOL, as well.
