Definition: Foreign labor law restricts the eligibility of non-U.S. citizens to work in the United States.
In order to gain permission to work temporarily or permanently in the U.S., an applicant must be eligible to reside in the U.S according to the Immigration and Nationality Act (INA). The potential employer must then gain approval from the Department of Labor (DOL).
Once approval from the DOL is granted, the employer must gain a visa for the applicant from the U.S. Citizen and Immigration Services. A visa is not guaranteed based on approval by the DOL.
