Document Everything -- and Get a Receipt

From Bruce Nolan

Why I Was Fired

I had worked for my employer for 6 1/2 years. During my second year, I was diagnosed with Severe Sleep Apnea. All documentation from my doctor was hand delivered by me to the Regional Office. Almost five years later, the CPAP machine that my doctor prescribed to control my Sleep Apnea, malfunctioned. The result was that I passed out while on duty from oxygen deprivation. I was suspended for three days and told to report to the Regional Office. The Regional Manager said that there were no medical records in my Personnel File. I was caught sleeping on the job and I was terminated for Misconduct.

What Being Fired Has Been Like

My last employer appealed against my Unemployment Insurance until the U.I. Board of Appeals subpoenaed my personnel files and medical records. That employer dropped their appeal and did not produce my records.

For almost two years I applied for hundreds of jobs, but not one employer called me for an interview. I am currently suing my former employer.

Advice

  • Document everything, no matter how small. If you give a document to your employer, get a receipt, or stamped copy marking it as received by your employer. If your case is truly just, don't wait, get a lawyer.
